Given that Udyam registration itself is free on the government portal, there is no economic rationale for any eligible business to remain unregistered.

The Section 15 and Section 16 Protection Under MSMED Act: Why It Matters

Two provisions of the MSMED Act 2006 are particularly important for registered MSMEs. Section 15 prohibits buyers from delaying payment for supplies made to them beyond the agreed credit period or, in the absence of an agreement, beyond 45 days from the day of acceptance or deemed acceptance of the goods or services. Section 16 further provides that if payment is delayed beyond the permitted period, the buyer must pay interest at three times the bank rate notified by the RBI — effectively a 12 to 15% penal interest rate on delayed payments. These provisions give registered MSMEs a powerful legal weapon against large buyers — including government departments and large corporations — who habitually delay payments to smaller suppliers. Without Udyam registration, a business cannot invoke these protections.
