Frequently asked questions

Who should file ITR-2 for AY 2026-27?

ITR-2 is for individuals and HUFs with income from capital gains (STCG / LTCG), more than one house property, foreign income, agricultural income above ₹5,000, or total income above ₹50 lakh. ITR-2 is NOT for taxpayers with business or profession income — they must file ITR-3.

What is the Section 112A LTCG tax rate for AY 2026-27?

Section 112A (introduced FY 2018-19) taxes LTCG on listed equity shares and equity-oriented mutual funds at 12.5% on gains exceeding ₹1.25 lakh per year, without indexation benefit. STCG on listed equity under Section 111A is taxed at 15% (revised to 20% from 23 July 2024 — verify current rate).

How is property capital gain calculated for ITR-2?

Property capital gain = Sale consideration (or stamp duty value, whichever higher) — indexed cost of acquisition — indexed cost of improvement. Indexation uses Cost Inflation Index (CII) from 2001-02 base. Section 54 / 54F exemption available on purchase of new residential property within specified time.

What is Schedule FA in ITR-2?

Schedule FA (Foreign Assets) requires disclosure of foreign bank accounts, foreign financial interests, foreign equity holdings, foreign immovable property, foreign trusts, and signing authority in foreign accounts. Non-disclosure attracts Section 271FA penalty of ₹10 lakh per AY. Even dormant accounts must be reported.

Can ITR-2 claim foreign tax credit under DTAA?

Yes. Under DTAA (Double Taxation Avoidance Agreement), residents can claim credit for foreign tax paid against Indian tax on the same income. File Form 67 along with ITR-2 — declaration of foreign tax paid and treaty claim. DTAA residency certificate and TRC required from foreign jurisdiction.

Can ITR-2 carry forward capital losses?

Yes. STCG and LTCG losses can be carried forward for 8 assessment years if ITR-2 is filed within the Section 139(1) due date (31 July 2026 for AY 2026-27). STCG loss can be set off against STCG and LTCG; LTCG loss against LTCG only. Belated return under Section 139(4) disallows loss carry-forward.

What is the fee for ITR-2 filing at FinTax24?

ITR-2 filing starts from ₹999 at FinTax24 — covers Schedule CG capital gains computation, Schedule FA foreign asset disclosure, multiple house property Schedule HP, deduction planning, and e-filing on incometax.gov.in. ESOP and property capital gains with indexation included.

What is the penalty for late filing of ITR-2?

Late filing of ITR-2 attracts Section 234F fee of ₹1,000 (income ≤ ₹5L) or ₹5,000 (income > ₹5L). Loss carry-forward is disallowed. Section 234A interest on unpaid tax applies. Section 271(1)(c) penalty of 100%-300% of tax for concealment of capital gains or foreign income disclosure failures.
