What is a Hindu Undivided Family (HUF)?

Who is the Karta of an HUF?

The senior most male coparcener is the Karta by default. The Hindu Succession (Amendment) Act 2005 also recognises a female as Karta. The Karta manages HUF affairs, has authority to partition, and represents the HUF in tax and legal matters.

Can a Hindu family have more than one HUF?

Can a non-Hindu form an HUF?

The Karta: Managing the HUF

A female member can become a karta only if she is the sole surviving coparcener — she cannot be karta alongside male members. All coparceners have a right to demand partition of the HUF property, which would dissolve the HUF into individual holdings. The HUF deed documents the family members, the ancestral property being brought into the HUF, the karta's authority, and the coparceners' rights. The Income Tax Appellate Tribunal and courts have consistently held that a deliberate splitting of income to avoid tax — rather than a genuine commercial arrangement — constitutes colourable tax evasion. The CBDT has the authority to invoke the General Anti-Avoidance Rule (GAAR) if the dominant purpose of HUF formation is tax avoidance. HUF formation does not reduce the total family tax burden if the income merely shifts from the individual's return to the HUF return with no real change in economic ownership. Additionally, HUF property is subject to partition claims by all coparceners, creating potential family disputes.
