How it works

  1. 1

    Scope Analysis [139(5) vs 139(8A)]

We determine whether Section 139(5) revision or Section 139(8A) ITR-U applies — based on AY window, original return filing date, and nature of correction.

  2. AY Window Check

For 139(5) — check AY end (31 March 2027 for AY 2026-27). For 139(8A) — confirm 24-month window from end of relevant AY is still open.

  3. 3

    Original ITR Comparison

Original ITR compared with correction needed — added income, corrected deductions, TDS mismatch, or excess/insufficient claims.

  4. 4

    Additional Tax Computation

    For 139(5) — additional tax + interest under 234A / 234B / 234C on the additional income. For 139(8A) — 25% (income ≤ ₹50L) or 50% (income > ₹50L) additional tax on updated income, paid via challan 280.

  5. JSON Drafting

ITR utility regenerated with corrected details and proper revision / update number — reviewed with taxpayer before e-filing.

  6. 6

    E-Filing & Verification

Revised ITR / ITR-U uploaded on incometax.gov.in with Aadhaar OTP / DSC verification. Challan 280 tax payment confirmed before ITR-U submission.

  7. 7

    Acknowledgment & Tracking

ITR-V issued; 143(1) intimation tracking for revised return. ITR-U acknowledgment tracked for additional tax paid and AO closure.

Frequently asked questions

Section 139(5) is a revision of the original return to correct mistakes — no additional tax other than interest under 234A / 234B / 234C. Multiple revisions allowed before AY end for timely-filed original returns; single revision for belated returns. Section 139(8A) ITR-U is a voluntary Updated Return for any AY within 24 months — additional 25% tax (income ≤ ₹50L) or 50% tax (income > ₹50L) on updated income. ITR-U cannot be further revised — but a fresh ITR-U can be filed within the 24-month window for additional disclosures.

No. Under Section 139(8A), an ITR-U cannot be further revised. However, if additional omission is discovered after filing ITR-U, a second ITR-U can be filed within the 24-month window from end of AY — provided no notice under Section 148A / 148 has been issued and no search under Section 132 has been conducted.

Under Section 139(5), a return originally filed under Section 139(1) can be revised any number of times before the end of the relevant AY (31 March 2027 for AY 2026-27) or before completion of assessment, whichever is earlier. Belated return filed under Section 139(4) can be revised only once.

Section 139(8A) prescribes additional 25% tax if total updated income does not exceed ₹50 lakh, and 50% if total updated income exceeds ₹50 lakh. This is in addition to normal tax, surcharge, cess, and interest under Section 234A / 234B / 234C on the updated income. The 25% / 50% is paid via challan 280 before ITR-U filing.

No. Under Section 139(5), revised return must be filed before end of relevant AY (31 March 2027 for AY 2026-27) or before completion of assessment, whichever is earlier. After AY end, ITR-U under Section 139(8A) is the only option — within 24 months from end of AY for the relevant AY.

ITR-U under Section 139(8A) must be filed within 24 months from the end of the AY for which the return is being updated. For AY 2026-27, the ITR-U window closes on 31 March 2029. For AY 2025-26, window closes 31 March 2028. For AY 2024-25, window closes 31 March 2027. Beyond 24 months, no ITR-U allowed.

Yes — partially. Section 139(8A)(7) provides immunity from Section 270A / 271(1)(c) penalty for the income disclosed in ITR-U. The additional 25% / 50% tax replaces the penalty exposure. Note: Section 139(8A)(7) does NOT provide immunity from prosecution under Section 276C or 276CC — only from the monetary penalty. This makes ITR-U a cost-effective way to disclose omissions before AO detection.

Revised ITR under 139(5) starts from ₹749 at FinTax24. ITR-U under 139(8A) starts from ₹2,499 — covers additional 25% / 50% tax computation, challan 280 support, and ITR-U filing. Multi-AY ITR-U starts from ₹4,499. Capital gains or foreign income updates priced from ₹3,999.
