TL;DR

FSSAI registration (basic) is for businesses with turnover up to ₹12 lakh. This covers small retailers, hawkers, and petty manufacturers. The companion piece on FSSAI renewal covers the renewal steps and what happens when an inspector visits.

The Food Safety and Standards Authority of India (FSSAI) runs under the Food Safety and Standards Act, 2006. Every food business operator (FBO) in India needs an FSSAI license or registration. The level you need depends on your scale of operations. This includes your turnover, type of business, and geography.

The Three Tiers

Tier Turnover Range Issued By Validity
FSSAI Basic Registration Up to ₹12 lakh State Food Safety Authority 1 to 5 years
FSSAI State License ₹12 lakh to ₹20 crore Designated Officer of the state 1 to 5 years
FSSAI Central License Above ₹20 crore or multi-state operations Central Licensing Authority (Delhi) 1 to 5 years

Basic registration is for petty food businesses. This covers small retailers, hawkers, itinerant vendors, small cottage industries, and small-scale processors. The state license is for mid-size operators. This covers restaurants, manufacturers, distributors, transporters, and storage operators. The central license is for large operators. This covers multi-state chains, large manufacturers, importers, and exporters.

What Counts as a Food Business

Under Section 3(1)(j) of the FSS Act, a “food business” is any undertaking for profit or not. It covers making, processing, packaging, storing, transporting, distributing, or selling food.

Examples of food businesses:

  • Restaurants, cafes, cloud kitchens.
  • Bakeries, confectioneries, sweet shops.
  • Packaged food manufacturers (chips, biscuits, sauces, pickles).
  • Dairy processors (milk, paneer, ghee).
  • Meat and seafood processors.
  • Beverages (juice, packaged drinking water, soft drinks — alcohol is regulated separately by state excise).
  • Caterers.
  • Food transporters (cold chain, frozen).
  • Food storage warehouses.
  • Food importers (raw materials, ingredients).
  • Online food aggregators (the FSSAI requires a central license).
  • Cloud kitchens operating under a brand.

If you handle food in any way, you need an FSSAI license or registration.

The Basic Registration (Turnover up to ₹12 lakh)

Eligibility

  • Small businesses with annual turnover not exceeding ₹12 lakh.
  • Petty retailers, hawkers, itinerant vendors, small cottage industries.

The Application — Form A

The application is filed on the FoSCoS (Food Safety Compliance System) portal at foscos.fssai.gov.in. The form requires:

  • Business name and address.
  • Proprietor’s or partner’s or director’s PAN and Aadhaar.
  • Photograph of the FBO.
  • Identity proof of the proprietor or partners or directors.
  • Address proof of the business premises.
  • Nature of business (manufacturing, retail, distribution, etc.).
  • Food category (dairy, bakery, packaged, etc.).
  • Annual turnover estimate.

The form is signed by the FBO using DSC or e-Sign (Aadhaar OTP). The fee is ₹100 for 1 year, ₹500 for 5 years.

The Approval Timeline

The basic registration usually comes within 7 to 30 days of your application. You can download the certificate from the FoSCoS portal. It carries the FSSAI registration number (a 14-digit number).

The Display Requirement

The FSSAI registration number must be displayed:

  • On the principal place of business — printed certificate displayed at the entrance.
  • On the product packaging — for packaged food businesses.
  • On the invoices and bills — for all transactions.
  • On the delivery vehicles — for transport businesses.

The display is the first thing the Food Safety Officer (FSO) checks. A missing display is a defect under Section 26 of the FSS Rules.

The State License (Turnover ₹12 lakh to ₹20 crore)

Eligibility

  • Mid-size food businesses with annual turnover exceeding ₹12 lakh but not exceeding ₹20 crore.
  • Restaurants, mid-size manufacturers, distributors, transporters, storage operators.

The Application — Form B

The application is filed on the FoSCoS portal. The form requires more documentation than Form A:

  • Business details — name, address, CIN (for companies), LLPIN (for LLPs).
  • Constitution — proprietorship, partnership, LLP, company, trust, etc.
  • Directors’ or partners’ details — PAN, Aadhaar, photograph.
  • Food Safety Management System (FSMS) plan — a document outlining the food safety practices, the HACCP or FSSC 22000 certifications (if any), the testing schedule, the recall plan.
  • List of food categories to be manufactured or processed or handled.
  • List of equipment and machinery.
  • Water analysis report (for manufacturers).
  • Recall plan.

The fee varies by the category of business and the license tenure. The fees are notified by FSSAI from time to time.

The Inspection

For a state license, the Designated Officer may inspect the premises before granting the license. The inspection checks that the premises is clean and well-ventilated. It checks that equipment is right for the food category. It checks that the water source is safe. It checks that pest control is in place. It checks waste disposal and that labelling is correct for packaged food.

The inspection is needed before the license is granted. If the premises fails, the licensee must fix the issues and request a re-inspection.

The Approval Timeline

The state license is typically issued within 30 to 60 days of the application. The delay depends on the inspection schedule and the Designated Officer’s workload.

The Central License (Turnover above ₹20 crore or Multi-State Operations)

Eligibility

  • Food businesses with annual turnover exceeding ₹20 crore.
  • Food businesses operating in multiple states (for example, a restaurant chain, a packaged food manufacturer with national distribution).
  • Food importers.
  • Online food aggregators (Zomato, Swiggy, etc.).
  • Food exporters (with FSSAI registration as a pre-requisite for export clearance).

The Application

The application is filed on the FoSCoS portal. But the Central Licensing Authority in Delhi processes it. The documentation is more detailed than for a state license.

The Inspection

The inspection for a central license is more detailed. The team has a Designated Officer, a food analyst, and a technical expert. The premises must meet the highest standards of food safety. These typically align with FSSC 22000 or BRC Global Standard.

The Approval Timeline

The central license is typically issued within 60 to 90 days of the application.

The Renewal

FSSAI licenses and registrations are valid for 1 to 5 years (you choose). You must file the renewal within the window. This is usually 180 days before expiry. The practical time to file is 30 to 60 days before expiry.

Renewal means:

  • Filing the renewal form on FoSCoS.
  • Paying the renewal fee plus late fee if any.
  • Giving a self-declaration that you comply with FSS Regulations.
  • A fresh inspection, but only if there is a change in product category, manufacturing process, or premises layout.

The Common Triggers for Upgrading the Tier

Trigger 1 — Turnover crosses ₹12 lakh

A petty retailer whose turnover crosses ₹12 lakh must upgrade from basic registration to state license. The upgrade is not automatic. The FBO must file a fresh application on the FoSCoS portal for the state license. The FBO must pay the state-license fee. The FBO must complete any inspection requirements and receive the state license. Continuing on the basic registration after crossing ₹12 lakh is non-compliant.

Trigger 2 — Turnover crosses ₹20 crore

A state licensee whose turnover crosses ₹20 crore must upgrade to central license. The upgrade is not automatic. A new application is filed with the Central Licensing Authority in Delhi. The documentation is more comprehensive. The central license is issued after the prescribed inspection and verification.

Trigger 3 — Multi-state expansion

A state licensee that opens operations in another state must apply for central license. The central license covers all states. This also requires a new application.

Trigger 4 — Online food aggregation

A restaurant that joins Zomato, Swiggy, or Amazon Pantry is a partner in an e-commerce food operation. The aggregator has the central license. The restaurant has the state license. The restaurant’s state license is sufficient for its own premises.

eCommerce sellers: If you sell food products on Amazon, Flipkart, Meesho, or any other online marketplace, the FSSAI license tier must match your actual turnover. Basic registration for under ₹12 lakh, state license for ₹12 lakh to ₹20 crore. Listing on a marketplace without the correct licence tier is non-compliant and risks platform removal. See FinTax24’s eCommerce GST Hub for the FSSAI compliance guide and GST registration requirements for food e-commerce businesses in Gujarat.

Common Mistakes

Mistake 1 — Operating without the appropriate tier

A petty retailer who crosses ₹12 lakh and continues with the basic registration is non-compliant. The FSO will issue a notice and may seize inventory.

Mistake 2 — Wrong food category in the application

A manufacturer that selects “bakery” but also manufactures dairy products is non-compliant. The food category must match the actual operations.

Mistake 3 — Missing the display requirement

The FSSAI number must be displayed on the premises, packaging, and invoices. A missing display is a defect.

Mistake 4 — Lapse in renewal

The renewal must be filed before the expiry. A lapsed license is non-compliant.

Mistake 5 — Director or partner change without updating the FSSAI

A change in the proprietor, partner, or director must be updated in the FSSAI certificate through an amendment. An outdated certificate is non-compliant.

When to Get Help

The tier selection (basic vs state vs central) depends on the business profile. A restaurant chain expanding across states, a packaged food manufacturer scaling up, or an importer or exporter all require the central license. The application, the inspection, and the renewal are non-trivial.

We routinely handle FSSAI registration, state license, and central license applications for clients. Our FSSAI license service covers the application, the documentation, the FSMS plan, the inspection coordination, and the renewal. Share your business profile on WhatsApp for a no-charge review.
