What is the LTCG tax rate on equity in FY 2025-26?
LTCG on listed equity and equity-oriented mutual funds is taxed at 12.5% (without indexation) on gains exceeding the ₹1.25 lakh annual exemption, per the Finance (No. 2) Act 2024 amendment that took effect from 23 July 2024. The old 10% rule without indexation and with ₹1 lakh exemption applies only to assets bought before 23 July 2024.
What is the STCG rate on equity?
STCG on listed equity sold within 12 months is taxed at 20% (raised from 15% by the Finance (No. 2) Act 2024). STCG also applies if equity MF units are redeemed before the 12-month lock-in. The Finance Act 2024 retains the 15% STCG rate until 22 July 2024 only — after that date, 20% applies.
How does indexation help on property?
Property bought before 23 July 2024 benefits from indexation using the Cost Inflation Index (CII) notified by the CBDT each year. The indexed cost reduces taxable gain, often producing a far lower LTCG than the raw sale-minus-purchase figure. This benefit was withdrawn for properties acquired on or after 23 July 2024.
What is Section 54 exemption for property?
If LTCG from sale of a residential house is reinvested in another residential property within 2 years (or constructed within 3 years), Section 54 exempts the gain. Capital gain bonds under Section 54EC (NHAI / REC / PFC / IRFC) can also be used within 6 months to claim exemption.
Is capital gain from crypto taxable?
Yes. Under Section 115BBH (effective 1 April 2022), gains from transfer of VDAs (virtual digital assets) — including cryptocurrency and NFTs — are taxed at a flat 30%, plus 4% cess. No indexation, no slab benefit, no carry-forward of losses against other income.
How are foreign capital gains taxed for an NRI?
Capital gains on foreign assets held by an NRI are taxed in India based on asset class and holding period, but DTAA relief may apply if the gain is also taxed in the source country. Disclosure in Schedule FA of the ITR is mandatory, with non-disclosure attracting penalty under Section 270A.
