Failure to obtain TAN attracts a penalty of ₹10,000 under Section 272BB. TAN is required to deduct TDS, deposit it with the government, file quarterly TDS returns, and issue TDS certificates (Form 16/16A) to deductees. Banks also ask for TAN to process TDS refunds and accept challans.
Deduct TDS on salary under Section 192, deposit via challan 281, and file Form 24Q.
Deduct TDS under Section 194I/194J, file Form 26Q, and issue Form 16A.
Deduct TDS under Section 195, file Form 27Q, and obtain Lower/Nil TDS certificate.
Collect TCS under Section 206C, file Form 27EQ, and deposit via challan 286.
Applying for a new TAN when a business starts deducting TDS, quoting TAN on every TDS challan and return, correcting TAN details, obtaining a lower-TDS certificate under Section 197, responding to intimation for non-filing of TDS returns, or settling a TDS default with interest.
The CBDT has made it mandatory to quote TAN on every TDS-related communication with the Income Tax Department. Late filing of TDS returns attracts a fee of ₹200/day under Section 234E, and incorrect TAN quoting is one of the most common reasons for demand notices.
