Eligibility Guide
Who Must File an Income Tax Return?
Do you have to file an ITR? It depends on your income, age, and where you live. You must file if your gross total income is over ₹3 lakh a year.
You must file an ITR if any of these apply, even if you owe no tax:
- Income limit — Your gross total income exceeds ₹3 lakh (₹3 lakh if you are 60–80 years old; ₹5 lakh if you are 80+).
- Foreign assets — If you are a resident Indian (not not-ordinarily resident) and own foreign assets worth more than ₹1 lakh, you must file.
- TDS refund — Even if your income is below the limit, you must file to claim a TDS refund.
- Foreign transactions — You bought foreign currency exceeding ₹5 lakh in one transaction, or you paid more than ₹1 lakh in taxes during the year.
- Business or profession — If you run a business or profession (even if it makes no profit), you must file once you have a PAN.
- Company or LLP — All companies and LLPs must file ITR. Income or loss does not matter.
Gujarat note: Salaried employees in Gujarat who earn only salary up to ₹7 lakh with deductions under Chapter VI-A (80C, 80D, HRA) may pay no tax under the new tax regime.
