The cap is per return per Act (CGST + SGST each have their own Rs 2,000 cap). If you are 40 days late on 3 GSTR-3Bs in a year with tax, your total late fee is Rs 2,000 (CGST) x 3 + Rs 2,000 (SGST) x 3 = Rs 12,000 for that return type — NOT a single annual cap of Rs 2,000.
Does QRMP change the late-fee math?
Yes — QRMP taxpayers file GSTR-1 quarterly (no IFF for the first month of the quarter) and GSTR-3B monthly via PMT-06. Late fee for GSTR-1 under QRMP: Rs 50/day per Act same as regular. Late fee for non-filing of PMT-06: Rs 50/day per Act + 18% interest on the unpaid tax.
Can I pay Section 50 interest without paying late fee?
No — Section 47 late fee is automatically assessed when the return is filed late. Section 50 interest is calculated on the tax due (even if the return is filed NIL but tax was payable). The two run in parallel.
Is there any amnesty that waives GST late fee?
